Znalecký – posudek – počítač – software – hardware – apod.

Znalecký posudek soudního znalce je soubor výroků dle zák. č. 254/2019 Sb. v platném znění. Má náležitosti dle §28 výše uvedeného zákona. V daném případě soubor výroků o hardware, software nebo ceně hardware či ceně licence k software.
Znalecký posudek musí disponovat stejnými náležitostmi i v případě, když se soudním znalcem vypracuje „mimo řízení“ tj. i pro jiné objednatele, než kterými jsou státní orgány. O obsahu znaleckého posudku významným způsobem rozhoduje tzv. znalecká otázka (zadání pro znalce). O její formulaci je vhodné se předem poradit. Znalecký posudek na počítač, software, hardware, elektroniku apod. by měl být jednoznačný a přezkoumatelný.

První podmínkou jednoznačnosti znaleckého posudku v oblasti komputerů, software, hardware, stanovení ceny atd. je kvalitní znalecká otázka. Znalecká otázka je de facto zadáním pro znalce. Jen kvalitní otázka implikuje možnost poskytnout kvalitní znaleckou odpověď (znalecký výrok), která je zužitkovatelná jako případný důkazní prostředek při sporu. S mohutným rozvojem digitalizace společnosti je dokazování s pomocí znalce čím dál častější nezbytností.
